Legal Agreement
This user agreement (“Agreement”) is an agreement is between you and Agent Muscle governing your use of Agent Muscle’s products and/or services with the characteristics and features as described on www.agentmuscle.com (“Website”). By accessing the website, at your option, registering thereon and thereafter using the Services as a member or guest, you agree to be bound by this Agreement and the terms contained in it. This Agreement governs your access and use of this Website and applies to all visitors, users and others who access the Service ("Users"). If you do not agree with the terms contained in this Agreement, you are not permitted to use this Website.
Agent Muscle will not be liable for any consequences arising from your unauthorized use. We may revise these terms of use at any time by amending this page and the terms hereof. The revised terms of use shall be posted on the Website and you are expected to check this page from time to time to take notice of any changes we make, as they are binding on you. Some of these provisions may be superseded by provisions or notices published elsewhere on our Website. All changes are effective as soon as we post them and by continuing to use the Website and avail of the Services, you agree to be bound by the revised terms and conditions of use. Your use of Website is subject to the most current version of the terms of use posted on the Website at the time of such use.
Agent Muscle has created this Website to provide Users, the Services which includes, guidance on how to improve their fitness and how to integrate fitness into their individual lifestyles and to provide the Users access to healthy fitness habits. While our workout and nutrition recommendations consider several factors specific to each individual, including anthropometric data, fitness goals and lifestyle factors, we are not a medical organization, and our recommended workout plans and specific exercises should not be misconstrued as medical advice, prescriptions, or diagnoses.
1. ACCESS
Access to the Services is permitted on a temporary basis, and we reserve the right to withdraw or amend the Service (or any features within the Services) that we provide on our Website by notifying the same on our Website from time to time without prior notice to you. We will not be liable, if for any reason our Website or the Services (or any features within the Services) are unavailable at any time or for any period. From time to time, we may, at our sole discretion, restrict access to some parts of our Website, or our entire Website, to Users who have registered with us.
i. Agent Muscle grants you permission to use the Services as set forth in this Agreement, provided that: (i) you will not copy or distribute, any part of the Services in any medium or in any manner whatsoever without Agent Muscle’s explicit authorisation in this regard; (ii) you will not alter or modify any part of the Services other than as may be reasonably necessary to use the Services for its intended purpose; and (iii) you will otherwise comply with the terms and conditions of this Agreement.
II. By entering your personal details after purchasing the Services, you warrant that: (a) all the data provided by you is accurate and complete; (b) you shall maintain the accuracy of such information, and any changes thereto by regular updation of any such information; (c) you affirm that you are over 18 (eighteen) years of age and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in this Agreement, and to abide by and comply with this Agreement; (d) you are eligible in accordance with applicable laws to enter into a binding contract and are not a person barred from receiving the Services under applicable laws ; and (e) you may use the Website or such other Services provided through the Website only in compliance with this Agreement and all applicable local, state, national, and international laws, rules and regulations. We shall not be liable for any injury, damage or other consequence, health related or otherwise arising out of any inaccuracy in the information provided by you on the Website.
III. Agent Muscle requires full body pictures (in regular clothing/gym wear) from you after purchasing services in order to assess and understand your body structure and fitness levels in a detailed manner. You need to share required images to get access to the final nutrition or workout plans from Agent Muscle. If you fail to share these images with Agent Muscle, you will be personally liable for any miscalculations or aberrations arising in your nutrition or workout plans due to lack of information. You will not hold Agent Muscle liable for any such miscalculations or aberrations due to lack of requested information from your end. You shall also ensure that the images shared with Agent Muscle over the website or over any other messaging platform are not explicit in nature, private parts of the body should be completely covered with clothing, any indecent submissions of images that go against the said rules will be liable for legal action.
IV. In order to access the services on the website, you will require the following tools:-
a) A strong internet connection (for weekly Zoom video call check ins with trainer)
b) an electronic device with a decent quality camera (mobile/tab/laptop), this is important for efficient communication between you and your trainerth trainer)
c) A pair of dumbbells (weight of dumbbells only as suggested by your trainer, if you opt for home workout)
d) Yoga mat (optional)
e) A personal workout space with enough ventilation and area, to do basic standing and jumping workout movements
f) A fully functioning personal food measurement scale to measure the weight of food items
g) A fully functioning personal bodyweight scale to measure your own body weight
h) A active Gym membership throughout the period of consultation with Agent Muscle (only applicable if you communicate with Agent Muscle about opting for a Gym workout)
i) Basic workout and hygiene accessories as required by your gym (Hand towel, deodorant, clean pair of shoes only worn indoors), only applicable if you communicate with Agent Muscle about opting for a Gym workout
2. Your Private Information
Agent Muscle takes client confidentiality very seriously. We do not share your personal pictures/videos/body statistics with any third parties. Client Testimonials or marketing promotions that are shown on the Agent Muscle website/social media handles are shared only after seeking written approvals on those respective pictures through our clients via email or personal messaging platforms.
3. Uploading Material To The Service
Whenever you make use of the Services (or any feature or part of the services) that allows you to upload personal information or material on the Website, you must comply with applicable data protection rules/laws and the content standards set out below. The content standards apply to each part of a contribution as well as to its whole. Your contribution must be accurate where it states facts, be genuinely held (where it states opinions), comply with the law applicable in any country from which it is posted; and be relevant to your posting or use of the Services.
4. Rights Reserved By Agent Muscle
4.1 We have the right to disclose your identity to any third party who validly claims and provides evidence that any material posted or uploaded by you to our Website constitutes a violation of their intellectual property rights, or of their right to privacy.
4.2 We have the right to immediately terminate your access or usage rights and remove non-compliant information or material, in case of non-compliance with these terms and conditions.
4.3 We have the right to investigate and prosecute violations of these terms and conditions to the fullest extent of the law and may involve and cooperate with law enforcement authorities in prosecuting Users who violate these terms and conditions.
4.4 We reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to: (a) satisfy any applicable law, regulation, legal process or governmental request; (b) enforce these terms and conditions, including investigation of potential violations hereof; (c) detect, prevent, or otherwise address fraud, security or technical issues; (d) respond to user support requests; or (e) protect the rights, property or safety of Agent Muscle, its Users and the public. Agent Muscle shall not be responsible or liable for the exercise or non-exercise of its rights under these terms and conditions in this regard.
4.5 We reserve the right to introduce or change the prices of all Services without any prior notice from us. This shall not be applicable for customers who have already purchased their products.
4.6 Agent Muscle shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Services.
5. Billing and Payment
5.1 Services are provided for a fee, if you elect to use paid services of Agent Muscle, you agree to the terms of sale, pricing, payment and billing policies applicable to such fees and charges. Agent Muscle may add new services for additional fees and charges, or amend fees and charges for existing services, at any time in its sole discretion.
5.2 You must notify Agent Muscle about any billing problems or discrepancies within 7 (seven) days after charges first appear on your account statement. If it is not brought to notice within 7 (seven) days, you agree to waive your right to dispute such problems or discrepancies.
5.3 In respect of purchases made on the Website, you hereby acknowledge and agree that no refund requests will be entertained in any manner whatsoever and no refunds will be initiated therefor.
6. Supplement Recommendations
By electing to purchase services of Agent Muscle, you understand that Agent Muscle is helping you in the capacity of a private fitness consultant. Agent Muscle is not into the business of supplement wholesale or retail, by seeking advice from Agent Muscle on fitness supplements for your fitness goals, you take complete responsibility for the authenticity, risks or results of products that you purchase online or through a physical retail store.
7. Cancellation/Postponement of Plans Or Weekly Zoom Video Calls
Once you have booked your plan, it is your responsibility to start executing the workouts at home or your respective gym from the start date mentioned on the Personalised workout plan sent by Agent Muscle. You shall also be liable towards starting your Diet Plan on the exact date mentioned on your first Personalised Diet Plan. Agent Muscle shall provide you with a maximum of 5 buffer days to get all the suggested food items and all the applicable “tools” as mentioned above in point IV under Clause (1.) i.e. “Access”. If a situation arises where you are unable to start your plans after purchasing Agent Muscle services on the start dates as mentioned in your Personalised plans, Agent Muscle shall not be liable to extend dates of services and you shall be responsible for the days missed. Hence, we urge you to buy our services only if you have a complete assurance of your availability during the entire course of the service. Agent Muscle shall not be liable for any Gym Workouts missed by you due to any unforeseen circumstances (if you opt for the gym workout plan).
If there is a postponement of a Zoom video call weekly check-in scheduled between you and your trainer due to unavailability of Agent Muscle authorities, the check in for the respective week shall be honoured on the very next date of availability of your trainer. If there is a delay or cancellation on your end towards your weekly video zoom call with your trainer, you shall be responsible to check on the next date of your trainer’s availability for the rescheduled call for a specific week. Agent Muscle shall not be liable to increase total number of weekly Zoom Video call check-ins with you in case of your unavailability.
8. Prerequisites for Home Workout Plans
As mentioned above in point IV under Clause (1.) i.e. “Access”, users who opt for Home Workouts after purchasing our services are required to purchase a pair of dumbbells for their personal usage. They can purchase the recommended amount of weights as suggested by Agent Muscle, through any retailer or online seller of their choice. The Fitness Plans mentioned on the website are not inclusive of the price of any equipment to be purchased by the customer.
9. Access To Exercise Tutorials Under Members Section
Active users of Agent Muscle services are provided with access to exercise tutorials under Members Section on the Home Page. These tutorials are strictly private property of Agent Muscle and its active users. Every individual user is provided with access to the exercise tutorials as soon as Agent Muscle’s services are purchased, it is the responsibility of the active user to keep their login credentials confidential through the course of their program and even after the services expire, failing to do so, the active user will be prosecuted in the court of law. Sharing of login credentials with immediate friends or family is also not permitted. Sharing of exercise tutorials on public platforms is also condemned. The exercise tutorials in Members Section have been created only for your personal usage. Some of the exercises mentioned in the workout plans is not present under the Members Section currently, as the service is being updated and shot continuously, new content is added in the members section to the best of Agent Muscle’s ability. We urge our users to bear with us in this regard and request the video of any missing exercises personally to their trainer over personal messaging platforms or email, the respective exercise video shall be shared with you by Agent Muscle at the earliest possible time.
10. Disclaimers
10.1 If you are older than 18 (eighteen) years of age, or if you have not been physically active for more than 1 (one) year, or if you have any medical history that may put you at risk, including, without limitation, one or more the following conditions, you are required to seek approval from a qualified health care practitioner prior to using the Services:
1. heart disease;
2. high blood pressure;
3. family history of high blood pressure or heart disease;
4. chest pain caused by previous exercise;
5. dizziness or loss of consciousness caused by previous exercise;
6. bone or joint problems;
7. diabetes, high cholesterol, obesity; or
8. Arthritis
10.2 Agent Muscle does not guarantee any fixed amount of weight loss, weight gain and muscle development in a stipulated time. Long lasting fitness milestones require continued dedication and hard work on your end. We at Agent Muscle do not believe in fitness crash courses, by opting for Agent Muscle’s services, you understand that all your fitness goals including weight loss, weight gain, muscle development or any other positive outcome is a direct result of your own lifestyle habits.
10.3 Product display packaging and client transformations displayed on Agent Muscle website are only for reference purposes. Transformations showcased on the website are individual results, which may vary from person to person.
10.4 Agent Muscle is not liable towards any injury or injuries, arising from workout techniques implemented by you. You, as an adult take complete responsibility towards any risks or injuries arising from a gym or home workout.
10.5 Agent Muscle reserves the right to terminate the contract with its customer at any given point in time without prior intimation.
